A TIMELY WARNING: The following piece, which is based on legal advice was sent to me by a concerned correspondent who wishes to remain anonymous. He says that it could be of benefit to farmers- or anyone involved in silage-cutting or similar operations that involve machinery leaving fields or premises and onto public roads and might save someone from a costly claim, valid or false. “The practice is widespread of placing bollards or signs on the public road for the purpose of warning road-users that vehicles, etc. are leaving fields and other off-road premises and entering the public road. Usually, the practice is most common in the busy periods of farming of silage and crop cutting and transport to farm-yards pits and barns. Normally, it is a trouble free routine practice and without adverse effects such as collisions with passing vehicles, etc. However, there is a serious aspect to placing such signs on public roads which could be very costly for the person responsible for placing the sign.
The law in reference, the 1993 Roads Act, states that it is an offence for any person to place a sign on a public road, without having the Council’s permission. It states that liability for any damages or loss caused by the placing of the sign falls on the person who placed the sign on the road. It is also the duty of the person involved to ensure that vehicles safely travel in and out farm property and on public roads. While such accidents or collisions may not always be found to be the fault of the farmer or other person concerned, it is imperative that every effort is made to ensure that nothing is left undone in ensuring that safety of road users is not put at risk. The written permission of the Local Authority should always be sought before placing signs on public roads, as it is the Local Authority, the County Council, which has the legal responsibility for maintaining public roads, and for allowing, or prohibiting, the placing of signs on public roads.”
